Cancellation policy
Article 1. Purpose
These terms govern pre-order sales of L'Élixir quotidien on the website viannecare.com. They supplement the General Terms and Conditions of Sale (GTC), available at viannecare.com/policies/terms-of-service, which remain applicable for anything not expressly provided below. In the event of a contradiction on a point relating to the pre-order, these terms prevail.
The pre-order allows the product to be reserved before it is in stock, by paying a deposit at the time of the order and then the balance on the date indicated during pre-order, before shipment.
Article 2. Seller
The sale is concluded with Vianne OÜ, a company under Estonian law, registered office Järvevana tee 9, 11314 Tallinn, Estonia, registry code 17439705, VAT EE102956308. Contact: hello@viannecare.com. Full identification of the Seller appears in the Legal Notice (viannecare.com/policies/legal-notice).
Article 3. Price and payment terms
The pre-order works in two stages:
- Deposit: €10 charged at the time of the order.
- Balance: approximately €21 charged on the date indicated during pre-order, before shipment.
- Total price: approximately €31 incl. tax, i.e. a discount of about 20% compared with the public retail price of €39.
The exact amount of the balance and any delivery charges is communicated to the Customer before the balance is charged. The Customer is informed by email of the expected date of the balance charge and has the option of cancelling their order before this charge (Article 6).
Failure to pay the balance within the indicated period may result in cancellation of the order and refund of the deposit, the product then being put back on sale.
Article 4. Estimated delivery date
The start of deliveries is estimated for 1 August 2026. This date is an estimate and not a firm commitment. The Customer is kept informed by email of the progress of production and of any change to the schedule.
Article 5. Delay and termination of the order
In accordance with Articles L216-1 and L216-6 of the French Consumer Code: if the Seller does not ship by the agreed date or, failing that, within thirty (30) days following the conclusion of the contract, the Customer may instruct the Seller to deliver within a reasonable additional period. Failing performance within this new period, the Customer may terminate the order. The sums paid (deposit and, where applicable, balance) are then refunded to them in full under the conditions of Article 7.
Article 6. Cancellation before shipment
The Customer may cancel their pre-order at any time before shipment, by a simple request sent to hello@viannecare.com. In this case, all sums already paid, including the deposit, are refunded to them. The deposit is therefore not lost in the event of cancellation before shipment.
Article 7. Right of withdrawal
The fourteen (14) day right of withdrawal provided for by the GTC (Article 8) and by Article L221-18 of the French Consumer Code applies to the pre-order.
- Before receipt of the product: the withdrawal period for the sale of goods only begins to run from the receipt of the product. The Customer may therefore cancel their pre-order at any time before shipment (Article 6) and be refunded in full.
- After receipt of the product: the Customer has fourteen (14) days from receipt to withdraw, as long as the sealed packaging has not been opened.
Exception (Article L221-28 of the French Consumer Code): as L'Élixir quotidien is an ingestible food supplement sealed for reasons of hygiene and health protection, the right of withdrawal can no longer be exercised once the product has been unsealed after delivery.
The refund is made without undue delay and no later than fourteen (14) days following the decision to withdraw (Article L221-24 of the French Consumer Code), using the same means of payment as that used for the order.
Article 8. Product
L'Élixir quotidien is a food supplement. It contains fish (Peptan F® marine collagen). The mandatory statements applicable to food supplements appear in the GTC (Article 3) and on the product label. A food supplement is not a medicine and is not a substitute for a varied, balanced diet or for medical treatment.
Article 9. Mediation and applicable law
The provisions of the GTC relating to consumer mediation (Estonian Consumer Disputes Committee and European Consumer Centre France) and to applicable law also apply to pre-order sales. The Consumer residing in France retains the benefit of the mandatory provisions of French consumer law (Article 6 of the Rome I Regulation).
